Landlords – Your health and safety obligations
Most landlords are unaware of their responsibilities as owners when dealing with the persistent stream of access requests made by Operators to inspect, maintain and upgrade their equipment.
S.2(4)(b) of the Occupiers’ Liability Act 1957 places obligations on property owners to ensure that contractors are sufficiently competent to undertake works on the premises and ensure that such works are supervised if necessary. There is a clear liability on landowners who fail to adhere to these obligations in the event of any health and safety incident on site.
This requirement also includes a legal duty of care on landlords to ensure any risks associated with the positioning of the telecommunications equipment as well as access routes used by personnel have been reduced, controlled or eliminated.
